Marwako To Pay GHC1Million For Selling Contaminated Food

Marwako Fast Food to pay over one million Ghana cedis in damages to plaintiffs who suffered food poisoning in 2022.

The plaintiffs, Winifred Tse, Rodger Bismark Tse, and Walter Tse, each receive GHc 345,000 in general damages and will jointly get GHc 25,215.48 in special damages. Additionally, the court awarded GHc 10,000 against the defendant for the plaintiffs’ legal representation costs and overall litigation expenses.

The plaintiffs, who are siblings, claimed they experienced food poisoning with symptoms such as abdominal pain, vomiting, and diarrhea after purchasing food from Marwako Fast Food on May 8, 2022.

The report revealed that Marwako was guilty based on the plaintiffs’ assertions. The food purchased on the day of the incident contained pathogens. However, there is no evidence on record regarding the source of this contamination.

The court found Marwako’s argument “untenable and in blatant and unbridled defiance of logic.” The court concluded that Marwako Fast Food breached its duty of care to its customers.
