The Court of Appeal has acquitted and discharged Minority Leader Hon Cassiel Ato Forson in the ongoing ambulance case, overturning the trial court’s order for him to present his defense.
At the court, Director of Legal Affairs for the National Democratic Congress (NDC), Edudzi Tamekloe, noted that the appeal arose after the trial court dismissed their “submission of no case,” which had found sufficient evidence against the accused.
The Court of Appeal, by a 2-1 vote, favoured the appeal and set aside the trial court’s directive to open the defence.
On June 6, the High Court in Accra denied Dr. Forson’s request for a mistrial and an investigation into the Attorney General’s conduct, stating he lacked sufficient grounds.
Dr Forson’s legal team argued that a leaked tape showed alleged misconduct by the Attorney General, which they believed warranted a mistrial.
The Court of Appeal’s recent ruling nullifies the trial court’s order and clears both Dr. Forson and Richard Jakpa of the current allegations.
