Chief Justice Gertrude Sackey Torkornoo has dismissed a petition from former Special Prosecutor Martin Amidu, who sought the removal of the current Special Prosecutor, Kissi Agyebeng.
Reports indicate that Mr. Amidu accused Agyebeng of serious misconduct, including procurement breaches in purchasing vehicles for the Office of the Special Prosecutor (OSP) and abuses of power involving judges and the administration of justice.
Mr Amidu claimed these actions warranted Agyebeng’s removal. However, the petition, forwarded to Justice Torkornoo on May 6, 2024, was found lacking in sufficient evidence and legal grounds.
Chief Justice Torkornoo determined that Amidu’s petition did not meet the required threshold to establish a prima facie case for Agyebeng’s removal.
Consequently, she concluded that the petition lacked the necessary factual and legal foundation for further investigation or action.
Confirming the Chief Justice’s decision, Amidu stated, “I have today received a one-page letter from the Presidency with reference number OSP 307/24/659 dated July 2, 2024, notifying me that: the Honourable Chief Justice, Mrs. Justice Gertrude Sackey Torkornoo, has submitted her review of the existence or absence of a prima facie case with respect to your petition.
In accordance with Section 15(3) of the Office of the Special Prosecutor Act, 2017, the Chief Justice determined that the factual and legal foundation of the petition fall short of the standard required to establish a prima facie case for the removal of the Special Prosecutor.’”
As a result, the Chief Justice found the petition lacking in merit and dismissed it.
