The Attorney General has appealed the Court of Appeal’s decision to acquit Minority Leader Dr Cassiel Ato Forson and Richard Jakpa in the ambulance procurement case.
In the Notice of Appeal filed on August 8, 2024, the Attorney General argues that the majority ruling misapplied the standard of proof required to determine whether the accused should have defended themselves.
The appeal also disputes the majority’s conclusion that the letters of credit did not constitute payment under the contract, asserting that this finding contradicts the evidence and is untenable.
Additionally, the appeal criticizes the majority’s determination that the Ministry of Health was responsible for the financial loss, claiming it contained fundamental errors and led to a significant miscarriage of justice.
The Attorney General urges the Supreme Court to overturn the acquittal and discharge and to require the accused to continue their defense.
